1. Acceptance of Terms
These Terms govern your use of TrustCall websites, applications and cloud PBX / VoIP services provided by [Company Legal Name] (TrustCall, we or us). By accepting these Terms or using the Services, you agree to them. If acting for an organization, you must have authority to bind it. A separately signed agreement controls to the extent it expressly conflicts with these Terms.
2. Eligibility
You must have legal capacity to enter this agreement and meet any age, residency, business or service eligibility requirements applicable to your location. Do not use the Services where their provision or use is prohibited.
3. Account Registration
Provide accurate account, business and contact details and keep them current. We may request information needed to establish eligibility, deliver services and comply with carrier or regulatory requirements. An account does not guarantee that a requested number or destination is available.
4. Account Security
Protect passwords, SIP credentials, devices and authentication tokens. Limit access to authorized users and notify [Support Email] promptly of suspected compromise. You are responsible for authorized account activity and for securing systems under your control, subject to applicable law.
5. KYC and Verification
Identity, business, address or use-case verification may be required depending on the service, country, phone number or use case. Submit genuine, current documents that you are authorized to provide. Uploading a document is not approval; activation may depend on review by TrustCall, a carrier or another verification provider.
6. Telecom and Regulatory Compliance
Use the Services consistently with applicable telecommunications, KYC, numbering, anti-fraud, privacy, data protection and communications rules. Carrier requirements may also apply. We may request updated information or restrict service when eligibility or compliance cannot be established.
7. TrustCall Services
TrustCall provides cloud PBX and business communications functionality made available under your plan. Features, supported devices, destinations and regional availability can differ. Your order and applicable service documentation describe what is included; a feature mentioned in a policy is not a promise that it is enabled for every account.
8. Phone Numbers
Numbers are subject to inventory, carrier acceptance, verification and ongoing eligibility. An order is not a completed allocation until confirmed. Number assignment gives a conditional right to use the number, not ownership. Renewal, release and porting depend on applicable law, carrier rules and order terms. A released number may be reassigned and may not be recoverable.
9. Calling Services
Call connection, audio quality and reachability depend on internet access, devices, power and interconnected networks. Destination or calling restrictions may apply. Do not rely on TrustCall for emergency calling unless emergency service for your particular account and location has been expressly confirmed; maintain an appropriate alternative means of emergency communication.
10. Unlimited Plans and Fair Use
"Unlimited" means up to 2,500 minutes per billing month under the applicable fair-use allowance, unless a customer's order, subscription, or separate service agreement states otherwise. The 2,500 minutes/month is the included fair-use allowance for normal business communication. Unlimited does not mean unrestricted commercial, automated, artificial, fraudulent or abusive traffic. Usage beyond the applicable allowance may be charged separately, require a higher plan or be restricted according to the applicable pricing/order terms. Fraudulent or abusive traffic can be restricted regardless of the minute allowance.
11. Billing and Payments
You agree to the prices, billing period, renewal arrangements and payment method disclosed in your order. Wallet funds may be reserved while a number purchase is being confirmed; a network timeout alone does not establish that an order failed. Confirmed failed purchases release their reservation. Other refunds and cancellations follow the applicable order, payment-channel terms and mandatory law; no blanket non-refundable rule overrides those rights. Notify support promptly of billing concerns.
12. Taxes and Regulatory Fees
Applicable taxes, duties, telecom surcharges and regulatory fees may apply as disclosed at checkout or in your order. Provide accurate billing information and any valid exemption documentation. Charges not included in an advertised price must be identified in the applicable pricing or order terms.
13. Call Recording
TrustCall may provide call recording where enabled. Before recording or using recordings, customers must obtain all legally required notices, consents and authorizations and comply with applicable recording laws. Laws vary by location and participant; recording is not automatically lawful everywhere. Manage access, use and retention of recordings responsibly.
14. Customer Responsibilities
You control your users, devices, integrations, calling campaigns and customer content. Obtain necessary permissions, keep contact and verification details accurate, and use suitable connectivity and security practices. You remain responsible for lawful communications and instructions given to TrustCall.
15. Prohibited Activities
Our Acceptable Use Policy forms part of these Terms. Fraud, scams, harassment, unlawful telemarketing or recording, prohibited caller-ID manipulation, artificial traffic, unauthorized network access and attempts to bypass carrier restrictions are prohibited.
16. Third-Party Services
Telecom/SIP carriers, cloud infrastructure, payment processors and other providers help deliver the Services. Their availability and applicable conditions may affect service. Third-party integrations you choose may be governed by separate terms; review those terms before granting access.
17. Service Availability
We aim to provide reliable service, but do not guarantee uninterrupted or error-free operation. Maintenance, incidents, network failures, carrier changes and circumstances outside our control may affect availability. Any committed service levels or credits must be expressly stated in your service agreement.
18. Suspension and Termination
We may restrict destinations, calling, phone numbers or accounts, or terminate service, for non-payment, material breach, fraud, security threats, carrier requirements or legal obligations. Where appropriate and permitted, we will provide notice and an opportunity to resolve the issue. Urgent protection or legal restrictions may require immediate action. Closure does not erase accrued charges or required record retention.
19. Intellectual Property
TrustCall and its licensors retain rights in the platform, software, branding and documentation. Subject to these Terms, you receive permission to use the Services for their intended purpose during your subscription. Do not copy, resell or exploit them beyond your agreement or rights under applicable law.
20. Customer Content
You retain rights in content you provide. You grant the permissions reasonably necessary to host, process, transmit and protect that content to deliver the Services, comply with law and carry out your instructions. You must have the rights and lawful basis necessary to provide it.
21. Data Processing
Our Privacy Policy explains processing of account, verification, billing, technical and calling information, including CDRs. Where we process personal information on your organization's behalf, applicable contractual data-processing terms and lawful instructions govern that processing. Contact [Privacy Email] for information about those arrangements.
22. Limitation of Liability
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the Services. Any financial liability cap must be set out in the applicable order or service agreement. Nothing excludes liability or remedies that cannot lawfully be excluded, including mandatory consumer protections.
23. Indemnification
To the extent permitted by law, business customers are responsible for third-party claims caused by their unlawful communications, infringing customer content or material breach of these Terms. Any indemnity is subject to applicable contractual procedures, reasonable notice and an opportunity to participate in the defense; it does not cover loss caused by TrustCall's own unlawful conduct.
24. Changes to Services
We may update features or change availability for operational, security, regulatory or carrier reasons. Material changes affecting a paid commitment will be handled according to your agreement and applicable notice, cancellation or other mandatory rights.
25. Changes to Terms
We may update these Terms and identify the effective and last-updated dates. We will provide additional notice or obtain consent where required. Changes do not retroactively remove mandatory rights. If you disagree with a material change, contact support about options under your agreement.
26. Governing Law
Any valid governing-law and dispute-resolution provisions in your signed agreement or order apply. Otherwise, applicable law determines governing law and jurisdiction. Nothing in these Terms removes mandatory rights or access to courts or regulators that apply to you; this page does not designate an unconfirmed jurisdiction.
